The panel of judges of the Sixth Appeal Administrative Court under the leadership of the judge recognized the decision of the Kyiv District Administrative Court as valid regarding the resolution of the Cabinet of Ministers of Ukraine dated March 1, 2024. No. 225 “Some issues of removal of trees, shrubs, lawns and flower beds during preparatory and/or construction works and operation of the National Military Memorial Cemetery.”

Environmentalists point out that this is the second court that has declared the government’s decision to start massive felling of the Markhaliv forest under the military cemetery to be illegal. It is also reported that the secretariat of the Berne Convention has already started a case against Ukraine for violating this document precisely because of the arrangement of the memorial military cemetery.
We will remind that in August 2023, the Cabinet of Ministers approved the implementation of the NVMK project in the Gatna community near Kyiv until August 2025. Later, the Ministry of Veterans Affairs was informed of plans to start the construction of the NVMK in the Gatnenska hromad near Kyiv at the end of November and put it into operation first by the end of the year. On December 7, 2023, the Ministry of Veterans presented to the public a sketch project of the NVMK and visual projects of unified tombstones.
Meanwhile, the Cabinet of Ministers of Ukraine approved the appearance of the graves of the National Military Cemetery.
Despite the disagreement of the families, work is currently underway on the “design and development of an appropriate architectural sketch”, RFE/RL was informed by the Ministry of the Interior. And soon the construction of the first phase of the memorial complex will begin. They are planned to be laid before the end of the year.
