Cabinet wants to fine Ukrainians for breach of a curfew

The Cabinet of Ministers has approved the bill that is proposed to impose penalties for violation of the curfew. This was reported by a government representative in Parliament Taras Melnychuk in Telegram. The bill proposes to add a new article to the Code of Administrative Offenses to the Code of Administrative Offenses, which will establish administrative responsibility for violation of the rules of martial law. The Cabinet of Ministers has approved the bill that is proposed to impose penalties for violation of the curfew.

The bill proposes to add a new article to the Code of Administrative Offenses to the Code of Administrative Offenses, which will establish administrative responsibility for violation of the rules of martial law.

It is about violations such as entry or stay in settlements where mandatory evacuation is carried out, without special permits or certificates.

The document also provides for liability for violation of the curfew – a ban on staying on the street or in other public places at a certain time without special permission.

In addition, Article 262 of the Code proposes to be amended that will give the police the right to detain violators.

The specific amount of fines proposed by the government is still unknown.

As of today, punishment according to general norms is possible for violation of the curfew.

In particular, if the person does not fulfill the legal requirements of the police officer, the protocol under Art. 185 KUPAP (“evil disobedience”). According to this article, they are possible:

  • fine from 136 to 255 UAH;
  • Public works: 40-60 hours;
  • Correctional works: 1-2 months with maintenance of 20% of earnings;
  • Administrative arrest up to 15 days.

There is no special article on penalties for violation of the curfew.

By the way, the Cabinet is already several times suggested The Council of Laws on penalties for violation of the curfew.

Earlier a petition with a call to cut The curfew in Kiev gained the required number of signatures, but was rejected.
