The court partially granted the petition of NABU detectives agreed by the SAP prosecutor and applied to the suspect a preventive measure in the form of UAH 4 million in pledge with the imposition of relevant procedural duties.
Under the procedural guidance of the SAP prosecutor, NABU detectives reported suspicion of seizing public funds during the purchase of services for the modernization of the hardware and software complex (hereinafter-APC) of the Ministry of Justice of Ukraine, namely:
- the former State Secretary of the Ministry of Justice;
- Head and Deputy Head of Departments of the Ministry of Justice;
- beneficial owner and two heads of private societies.
To date, the actions of the suspects are qualified under Part 5 of Art. 191 of the Criminal Code of Ukraine. The head of the Ministry of Justice of Ukraine was additionally charged with the commission of the crime under Part 1 of Art. 263 of the Criminal Code of Ukraine.
Details of the scheme
Within the framework of the pre -trial investigation, it was found that the beneficial owner of the company developed a criminal scheme with the participation of officials of the Ministry of Justice for the seizure of public funds during the purchase of agro -agricultural services.
According to the scheme, officials made changes to the estimate for 2021, and the heads of the private company organized the preparation of the technical task for the modernization of the complex, indicating the specific requirements for the characteristics of equipment, which ensured the victory in the tenders of this company.
In addition, it turned out that the cost of services, indicated in the commercial offers of the company, was significantly overstated.
Another private firm was attracted to ensure the visibility of the trading of a person, but its tender proposal was recognized as less commercially attractive. As a result, the implementation of this scheme led to the task of losses of the Ministry of Justice in the amount of more than 10 million UAH.
