The lawyer Marina Bekalo explained that the project of the law in Ukraine is proposed to create a new body – military police, which will include military personnel. They will be entrusted with the powers to ensure law enforcement and military discipline in the Ministry of Defense of Ukraine, the Armed Forces of Ukraine and the State Special Transport Service.
Military police will receive a number of new powers:
- Clarification of circumstances, investigation, identification and prevention of military offenses, including military discipline, in military units and military formations (including official inspections, support of war and law enforcement agencies, and prisons)
- Provision of law enforcement in the conditions of legal regime of martial law, including inspections of vehicles, establishing the circumstances of an accident, with the participation of drivers and other persons who managed the military vehicles of the Ministry of Education and Science of Ukraine, the Armed Forces, and the State Special Service
- Ensuring the observance of a curfew
- Protection of prisoners of war
- Fighting hostile sabotage and intelligence groups
- Protection of military objects, military towns and their population
- Restoring and maintaining order and discipline in military units
- Other powers provided by the legislation on the legal regime of martial law
In addition, in urgent cases related to the salvation of people, property or persecution of suspects, police will be able to penetrate the dwelling or other possession of a person, but with the obligatory notification of investigative bodies and prosecutors.
For failure to comply with the requirements or legal orders of military police officials, citizens will be fined up to UAH 17,000.
The new bill provides for appropriate amendments to the Criminal Code, the Criminal Procedure Code and the Code of Administrative Offenses.
Military police will be funded by the State Budget through the Ministry of Defense, as well as from other sources allowed by international international treaties.
Backalo’s lawyer noted that the bill is largely concerned with the area of military service, investigation and prevention of war crimes and ensuring the implementation of the legislation on the legal regime of martial law.
“That is, the project applies to special entities that relate to the security and defense sector, in particular the Ministry of Education and Science, the Armed Forces and the State Special Service of Transport,” the lawyer explained.
Civilians this project only concerns the inspection of vehicles – surface inspection and documents certifying the person and the right to drive vehicles.
The bill was considered and sent for revision. Currently, amendments are being prepared for the second reading, taking into account the comments made by the profile committees of the Verkhovna Rada.
The lawyer Maryna Bekalo added that the presence of a special law enforcement agency that would be purely military offenses is objectively necessary for war conditions.
“Due to the lack of special knowledge, clearly defined powers, qualifications and competencies in the field of military affairs and military offenses with representatives of the National Police and the State Bureau of Investigation,” she said.
It should be added that a special law enforcement agency to maintain law enforcement in the Armed Forces and other military and paramilitary formations has been created and works in many countries of the world. In particular in Austria, Belgium, Brazil, the United Kingdom, Israel, Germany, the USA, Finland and others.
Last year, police recorded more than 340 cases of arson of military car. In 2023, these were isolated cases.
