The state institution “NVMK” explained to hromadske that the current legislation on the funeral business directly prohibits the liquidation of existing resting places. What’s more, the object is in state ownership, which excludes the possibility of its privatization, lease or change of purpose of the land plot, even in the event of legal disputes regarding the procedures for its allocation.
The legal status of the memorial complex remains stable, as the state registration of the right to permanent use of the land by the “NVMK” institution is currently valid and has not been canceled. Representatives of the cemetery emphasize that the object’s status as state property reliably protects it from any attempts at alienation or liquidation. Such a position is important for the preservation of public peace and the dignified commemoration of heroes, because any instability around military graves could be used by Russian propaganda to destabilize the internal situation in Ukraine.
The Ukrainian military reacted sharply to the decision of the Supreme Court, which recognized the illegal transfer of the plot of land for the National Memorial Cemetery. Defenders call it an insult to the memory of fallen brothers and call for an immediate review of the situation.
