The Kyiv City Prosecutor’s Office reported that the regular court session on the accusation of a former judge in committing a fatal traffic accident at a checkpoint in Kyiv, scheduled for January 26, did not take place again due to the absence of lawyers.

The prosecutor’s office does not name the accused, but the circumstances point to former judge Oleksiy Tandyr.

“In the Sviatoshyn district court of Kyiv, they were supposed to continue the trial of the case against a former judge of one of the district courts of the Kyiv region for committing a fatal road accident in which a 22-year-old serviceman died. Two defense attorneys of the accused did not appear at the court session, so the session was postponed to January 28, 2026,” the message reads.

The prosecutor’s office recalled that the preliminary court hearing in the case was held on September 6, 2023, the hearing is being conducted by the Svyatoshyn District Court of Kyiv, “sessions are scheduled regularly at intervals of 10-20 days, without long breaks.”

“At the same time, the prosecution has repeatedly recorded attempts by the accused to delay the trial. Most of the court hearings began with motions for the removal of the judge, a ban on the presence of journalists, numerous objections on formal grounds. In addition, the accused broke contracts with lawyers and, referring to their absence, demanded the postponement of meetings. In such cases, the court provided him with a free defense attorney,” the message reads.

Tandyr and his defense have not yet commented on the statement of the prosecutor’s office. On January 22, the European Court of Human Rights ruled that the detention of ex-judge Tandir for more than two and a half years without consideration of alternative preventive measures violates Article 5 of the European Convention on Human Rights, Suspilne reported. The ECtHR awarded Tandyr 2,100 euros in compensation for moral damage and 250 euros in compensation for court costs, which Ukraine must pay.

The Prosecutor’s Office of Kyiv noted that they insisted on an alternative preventive measure in the form of detention, recalling that, in particular, in December 2023, the accused tried to mobilize to the territorial defense unit in Nizhyn, using this as a reason for release from custody.

“The prosecution considered such actions as an attempt to stop the trial. Later, the military unit refused to accept him for service. The position of the prosecutor’s office remains unchanged: in case of choosing a preventive measure not related to detention, it will be impossible to ensure proper procedural behavior of the accused. For more than two and a half years, he has systematically shown disrespect for the court, the prosecution and the family of the fallen serviceman,” the message reads.

According to the investigation, on the night of May 26, 2023, Oleksiy Tandyr, head of the Makariv district court of the Kyiv region, committed a road accident at a roadblock in Kyiv, resulting in the death of 23-year-old Vadym Bondarenko, who was serving in the National Guard. The judge is suspected of violating traffic safety rules, driving a vehicle while intoxicated, which caused the victim’s death.

At the beginning of August 2023, employees of the SBI completed the pre-trial investigation of Oleksiy Tandyr.

Immediately after the accident, during the meeting of the High Council of Justice (HCJ), Tandyr denied that he was intoxicated. At the same time, during the meeting, Tandyr pleaded guilty to the beating of a Ukrainian serviceman and assured that he would cooperate with the investigation.

At the beginning of August 2024, the Supreme Council of Justice decided to dismiss the accused Oleksiy Tandyr from the post of judge.
