“Despite the fact that the very idea of tenders should exclude abuse and corruption risks, some procurements are still won by companies related to each other through owners or ultimate beneficiaries. The law allows such agreements only in cases where the share of relatedness is no more than 25%,” experts noted.
They emphasized that in in some cases, it may be a simple coincidence or a corporate structure that does not formally violate the Law.
But 32 such purchases for UAH 501.2 million already go beyond the limits: Opendatabot revealed a direct connection between the participants and the winner at a level of 25% or more, which is a gross violation of the Law of Ukraine “On Public Procurement”.
It is said that a tender for 468.3 million hryvnias was opened by the three leaders of such purchases. In the tender announced by Ukrnafta, BC Ukrburservista Spetsmekhservis participated, the owners of which have another joint company — Naftogazekologiya.
“Formally, it looks like a competition between two different participants, but in fact they may be elements of the same business group, which plays out the tender “in the family”, analysts note.
The second most problematic procurement is UAH 10.4 million. Here, the Spetskran company and VP KHEAZ turned out to be related to each other. Both businesses have the same co-owner, the study said.
The third largest purchase with illegal connections — for 4.7 million hryvnias. According to analysts, only 2 private enterprises Poltavske and Boryspilske, which have the same owner, participated in the tender.
Experts also note that another 19 purchases for UAH 256.3 million, which were divided into lots. In these procedures, companies with confirmed connections participated in different lots of the same tender.
They emphasize that fnormally, this is not a violation of the law, because each lot is considered a separate item of purchase. At the same time, in essence, the situation looks the same: related companies simultaneously work within the same procurement, which creates additional risks for real competition.
