The organization reminds that after the beginning of the Russian aggression, Otrosh regularly traveled to the temporarily occupied Crimea and St. Petersburg to exhibitions and “to relatives”.

Also, during the interview, she accused the Ukrainian authorities of occupying Crimea, started her career with VIP conditions unavailable to other judges, and has valuable property that is not explained by official income.

Back in 2019, Otrosh appealed the decision of the High Qualification Commission of Judges in the Supreme Court, so she did not want to go to the meeting with the full composition of the Supreme Court. The Grand Chamber decided that if Otrosh has a negative opinion of the Public Integrity Council, then a meeting with the full composition of the Qualification Commission is mandatory.

In 2024, at such a meeting, the Supreme Council of Justice recommended that the judge be dismissed, and the Supreme Council of Justice supported this decision.

This time, Otrosh contested her dismissal based on the results of the qualification assessment already in 2024. The ex-judge referred to the so-called Babiya law, which supposedly allowed a separate “caste” of judges not to undergo a second interview with the Supreme Court of Appeals, despite the conclusion of the State Administrative Court.

Literally DEJURE: “The Grand Chamber made a decision in a similar (albeit less resonant) case and annulled the results of the qualification assessment of another judge – Marina Lozynska.

This practice became a “convenient bridge” for the return of the scandalous Otrosh. The Public Integrity Council, the High Qualification Commission of Judges and the High Council of Justice have already unequivocally stated that the dismissal of Otrosh is legitimate, and that there are no “simplified procedures” for privileged judges, but the Grand Chamber of the Supreme Court decided otherwise.”
