The prosecutor’s office lost a court case over the lease of space in the war museum

The commercial court of the city of Kyiv refused the prosecutor’s office’s claim for the forced eviction of Ukrtechnozbut LLC from the premises of the National Museum of the History of Ukraine in the Second World War, located near the Motherland-Mother monument.

This is evidenced by the court decision of October 15.

Prosecutors cited the need to free up additional space for renewed museum activity in conditions of a full-scale war as the reason for the appeal to the court.

However, the court came to the conclusion that the mere fact of changing socio-political circumstances does not cancel the current lease agreement, the term of which has not yet ended.

The dispute concerned a small room on the first floor of the museum building with an area of ​​about 15 square meters. m at the address: Kyiv, prov. Zapecherny, 2.

This property is on the balance sheet of the museum, but in 2005 the State Property Fund leased it to the private company “Ukrtechnozbut”.

After that, the parties repeatedly continued the lease relationship, concluding additional agreements specifying the terms of use of the premises.

The last of such agreements provided for the validity of the lease until January 10, 2030. Despite this, starting in 2023, the management of the museum began to officially address the tenant with the demand to return the occupied premises.

The representatives of “Ukrtechnozbut” did not respond to the letters and initiatives of the museum, which ultimately became the reason for the involvement of the prosecutor’s office.
