Pechersk court chose a precautionary measure to the main witness in the case of NABU detective Magamedrasulov Yusuf Mameshev. The prosecutor’s office suspects Mameshev of giving knowingly false testimony. The court assigned him a preventive measure in the form of a personal commitment.
What incriminates the witness
According to the prosecutors, Mameshev during interrogations referred to Uzbekistan as a country to which the sale of technical hemp and related raw materials was allegedly planned. Prosecutors insist that the results of the audio examination refute his testimony – according to them, Magamedrasulov and his father discussed the possible sale of products to Dagestan, not Uzbekistan. This, according to the prosecution, confirms the falsity of the testimony Mamesheva.
Defense position
Mamesheva’s lawyer denied all the accusations, insisting that her client answered all the questions of the investigators truthfully.
The lawyer also drew the court’s attention to the fact that the prosecutor’s motion mentioned an electronic bracelet, although it had not been publicly announced before.
Mameshev himself stated that he ended up in the case because family ties with the Magamedrasulovs . He confirmed that both his family and the family of the NABU detective come from Dagestan.
Court decision
The court satisfied the request of the prosecutors and appointed Mamesheva personal commitment obliging him to:
- hand over a foreign passport;
- to appear on a court summons;
- wear an electronic means of control.
What are the Magamedrasulovs accused of?
According to the investigation, Ruslan Magamedrasulov and his father Sentyabr tried to sell seeds of technical hemp to Russia. The SBU believes that the detective acted as an intermediary in this device, and his father was engaged in illegal cultivation. At the same time, from September 2022, any trade with Russia is completely prohibited.
Among the materials of the indictment is a recording of a telephone conversation between a NABU detective and his acquaintance, in which the sale of seeds was allegedly discussed and the Dagestan buyer company appears.
However, the lawyers insist that the recording was edited. Instead of “Dagestan”, they say, “Uzbekistan” sounded in the conversation. Lawyer Olena Shcherban emphasizes: there are no state programs for the cultivation of technical hemp in Dagestan, unlike in Uzbekistan, where such initiatives are really active. In addition, the company mentioned by the investigation has significant debts and cannot claim state subsidies.
The defense insisted on summoning a witness to the court – a friend of the Magamedrasulov family, who participated in the same telephone conversation.
What the witness was talking about
The witness in the case was Yusuf Mameshev, an old acquaintance of the Magamedrasul family. He confirmed that Ruslan’s father grew technical hemp in the Zhytomyr region. According to Mameshev, the phone conversation took place in February this year: Ruslan asked him to help find buyers in Uzbekistan, because he knew about his connections there.
“Yes, that’s my voice on the record. We were talking about Uzbekistan. Ruslan asked to know if his Uzbek friends needed seeds. There is neither land nor factories in Dagestan where it would be possible to do this,” said the witness.
Mameshev said that he was interrogated three times by the SBU and that he was under pressure. According to him, representatives of law enforcement agencies came to him and threatened “problems” if he did not change the shows. Later, he was even declared “wanted” in the “Reserve+” application, and the next day he was detained by the police and taken to the TCC.
The prosecutor’s office attached a psychological examination to the case file, according to which the witness allegedly “tends to invent details” and is also confused in his testimony.
However, the lawyers stated that the examination has no legal force, because the certificate of the specialist who conducted it expired half a year before the examination.
What happened in the Pechersk courtroom
On October 27, the Pechersk District Court of Kyiv ordered a preventive measure for Mamesheva in the form of a personal commitment until November 11. Judge Oleg Bilotserkivets ordered Mameshev to hand in his foreign passports and wear an electronic bracelet. He was obliged to wear an electronic bracelet and hand in his foreign passports. The SBU believes that the sworn testimony given by Mameshev could have been false. Instead, Mameshev continues to insist that the conversation was about Uzbekistan, not Dagestan, but law enforcement officers intimidate him and his son .
At the court hearing, Yusuf Mamashev noted that he did not lie during the interrogations: “It doesn’t matter to anyone, but I am a deeply religious person. And when they tell me that I am capable of deception, it hurts the most.”
Mameshev confirms that he has family in Dagestan and is in frequent contact with them, but for the last ten years before the full-scale invasion, his business and financial ties were closely tied to Uzbekistan.
“Yes, I was born in Dagestan. Yes, I have relatives there, and every week and after the merciless shelling, my brother and sisters call me, they worry and pray for us. 10 years before the full-scale invasion, my life was closely connected with Uzbekistan. These are large companies that paid millions in taxes in Ukraine, but moved their business to Uzbekistan in 2022. I see that Ruslan Magamedrasulov is being destroyed, his father is a hostage of circumstances, and I am included. Now I am being threatened, my son was texted from an unknown number: “Father will be imprisoned anyway, take him abroad.” I said to write back that my father will not leave for the sign of Kyiv, let them not even hope. I have lived in Kyiv since 1989, in 1991 I was an activist in the independence referendum. I am a Ukrainian patriot, but never! I could never have imagined that I would find myself in such a situation. Like the period of Stalinist repressions…”
Previously, the suspect was NABU detective Ruslan Magamedrasulov confirmedwho was tortured in the detention center, and did not deny the authenticity of the so-called “Mindic tapes”.
