“Ukrenergo” focuses on opportunities for industrial enterprises and commercial structures to ensure stable supply energy even during the introduction of restrictions. A necessary condition for this is the independent import of at least 60% of the total volume of own electricity consumption. The specified criteria are fixed by the Resolution of the Cabinet of Ministers of Ukraine.

How commercial structures and industrial enterprises can independently import electricity for their own needs The sequence of actions for consumers (with the exception of the population) for the purpose of importing electric energy for their own use, according to the Resolution of the CMU of October 27, 2023 No. 1127:

  • Option 1: purchase of imported electricity from an electricity supplier. Consumers independently determine their electricity supplier, which is a participant in the electricity market of Ukraine and has the ability to supply imported electricity. One of such market participants can be a supplier that directly participates in the bidding for the distribution of access to interstate connections, that is, directly carries out the primary import of imported electricity into Ukraine.   • Option 2: the purchase of imported electricity is carried out directly by the consumer after acquiring the status of a participant in the electricity market of Ukraine. 1. The consumer must apply to NEC “Ukrenergo” to conclude binding agreements, in accordance with the requirements of the Law of Ukraine “On the Electricity Market”. You can get acquainted with the terms of the agreements and the order of actions at the link. 2. In order to carry out the supply of imported electric energy for the purpose of using it for its own needs, the consumer should find a non-resident counterparty that is a participant in the market of a neighboring country, who will be engaged in the export of electricity to Ukraine and with whom the consumer plans to carry out joint movement of electricity across the customs border of Ukraine. 3. The consumer and his non-resident counterparty must decide which of them will participate in joint bidding for the allocation of access to interstate connections. The designated party to obtain access to the intersection must acquire the status of a registered participant by concluding an agreement on participation in the distribution with the Auction Office. After successfully obtaining access to tenders for the distribution of access to interstate connections, it is necessary to participate in the relevant tenders and become the winner of these tenders. 5. According to the results of the respective auctions, the owners of crossing rights (physical transmission rights) will receive from the relevant Auction Office a rights document, which will indicate the hourly information on the possible supply of imported electricity for the relevant date. 6. The winning bidder sends the rights document to his counterparty. 7. Based on the received rights document, in accordance with the Nomination Rules, the consumer and his counterparty make nominations to the market management systems – each in their own country – indicating the final volume of electricity movement across the customs border of Ukraine. After making nominations, the consumer and his counterparty from the other side of the border – NEC “Ukrenergo”, together with the operator of the transmission system of the neighboring country, check and agree between themselves the schedule of movement of imported electric energy across the customs border of Ukraine. 9. After the nominations have been approved, the consumer will receive a notification confirming the transfer of electricity to Ukraine. 10. Within the limits of confirmed volumes, the consumer has the right to use electric energy as imported. 11. Forced restriction of electricity supply shall not be applied to the consumer, provided that in each billing hour the volume of purchased imported electric energy is at least 80% of the total volume of its consumption.
