Profile clinics also opposed the Law No. 13683.
The Cabinet of Ministers of Ukraine has submitted to the Verkhovna Rada the bill No. 13683 “On the use of auxiliary reproductive technologies” (DRT). However, the document has received many comments from experts, doctors and the public, because it poses serious threats to reproductive medicine in Ukraine.
Reproductive Medicine: The threats of a new billThe explanatory note to the document states that there are many issues related to the use of the latest treatment of infertility, which leads to a number of problems for medical institutions and patients. Instead, the legal and organizational foundations of the human pool of the human pool, the creation of conditions for the use of all the achievements of medical science and technology to preserve reproductive potential and ensure the exercise of the right of men and women to continue the genus are envisaged at the legislative level. At the same time, the specialists have a lot of comments: in their opinion, in the case of adoption of the bill, reproductive medicine in Ukraine will be threatened.
Valery Zukin”First of all, there are no state guarantees to pay for treatment. From January 1, 2024, a package of assisted reproductive technologies has been included in the NSAC package. But in practice, the Cabinet approves the volume of state medical guarantees every year. If this is not in the law, theoretically government officials may not approve the volume and this very important package will be removed“, – Vice president of the Ukrainian Association of Reproductive Medicine (UARM), Candidate of Mednauk, Laureate of the State President Valery Zukin told at a press conference in Kyiv.
The law of the law is prohibited by the donation of embryos: it can only be transferred to a woman who is genetically linked. Although today from 5% to 10% of reproductive cycles are carried out with donor embryos, who leave married couples who have been successfully treated in the clinic for “altruistic donation”.
”On the one hand, embryos donation is needed for older women who do not have their eggs – unfortunately, there are more and more now. On the other hand, it is important to married couples, where both have no germ cells. The bill is doomed to healthy embryos that are no longer needed by a married couple, for disposal“, – explained Vice president of Warm.
According to him, the document does not provide for pre -implantation genetic diagnostics of fertile couples, which have genetic risks (usually they have a choice – to be pregnant naturally and perinatal diagnostics during pregnancy, or to determine the embryo and not to do unnecessary termination).
”The general tone of the law is such that this treatment is as if the last hope, that is, a couple has a very long time before it gets a chance to take advantage of DRT. In fact, in such a demographic crisis, every child is weighty. It is necessary to facilitate people’s path to paternity rather than limit“, – Zukin summed up.
Profile clinics also opposed the Law No. 13683. They are in the Warm structure – 60 (five communal property, three state and the rest – private), all adhere to international security and ethics standards.

In his opinion, in the question of the adoption of such a law, it is necessary to repel first of all from patients, also to listen to the opinion of lawyers, the professional society, religious communities, so that the document meets the standards.
Reproductive medicine is about hope rather than a restrictionPeople’s Deputy Maria Ionova says that the need for human capital, the demographic crisis and the predictions that experts give today, they leave no other way out, how to really regulate the field of reproductive medicine in Ukraine. However, the bill should not only be approved, but also be one that can be implemented in practice.
Maria IonovaAgainst the background of the war, doctors are increasingly talking about the rapid deterioration of the health of men and women due to stressful situations, about the effect of post -traumatic syndromes. Therefore, the parliamentarian emphasized that legislators need to look for ways in order for birth rates to increase so that the state gives the right to have a child to both families and an individual woman or husband.
”There is a restriction in the same law. Why should we ban a woman who, say, lost her husband or son, to exercise her right to have a baby? It is the issue of protection of patients, children. In addition, we are all witnessing the outflow of human capital. Therefore, the development of reproductive technologies, as for me, can be considered even in the context of national security“, – said Ionova.
Yana ZinkevichPeople’s Deputy, Volunteer Medicine Yana Zinkevich noted that a large number of people now need the necessary treatment of reproductive functions, and this is extremely important.
”The government law does not take into account the opinion of the best specialists in the industry. There are so many harsh restrictions that are inappropriate for us now, because the country is demographic crisis, war and martial law when very few women and men agree to become parents and little understand what reproductive medicine is at all“, – she said.
Both emphasized: the state should help that the maximum number of children be born in Ukraine so that expectant parents do not need to go abroad, look for a reproductive medicine center and do additional research that we want to ban. The deputies registered an alternative project, which was rejected because of “some regulatory rules”, so they send appropriate appeals to the Regulatory Committee.
”We have to provide all the conditions within the country. Therefore, we will work for the government document to be rejected and we will develop it again“, – Zinkevich summarized.
Prospects for reproductive medicine under threatReproductive medicine – is an area that deals with the diagnosis and treatment of problems that interfere with the natural conception of the child. It helps people who cannot give birth to babies naturally, to realize their desire to become parents. UARM -Organization, which deals with the development of reproductive medicine in Ukraine, organizes scientific measures for doctors, promotes the development of science and practice in the field of human reproduction.
According to the Association, about 6% of all children in Ukraine are born through DRT. In 2022, 23.5 thousand cycles were held in the country, in 2023 – 33.4 thousand, which resulted in about 10 thousand children. For comparison, 77.5 thousand DRT cycles were held in Britain and 20.7 thousand babies were born. Thus, the percentage of successful cycles in Ukraine is 28%, in Britain – 25% (up to 15-20% of children after DRT in this country is born after the use of donor eggs or embryos).
”And in the government bill they want to limit the donation of embryos, and then we will not have 10 thousand children, but 8 thousand, and what will we achieve?” – said UARM President Alexander Yuzko.
