Consideration of the case The court found that on February 13, 2024, the woman appealed to the Pension Fund of Ukraine for a housing subsidy to cover the costs of housing and communal services of her household. In her statement of granting a subsidy, she confirmed that it is familiar with the conditions, according to which, in the event of circumstances, capable of influencing the subsidy, in particular, the purchase of property, goods or payment of services for an amount exceeding 50 thousand hryvnias, is obliged to notify the authority within 30 thousand hryvnias within 30 calendar days. According to the results of its application, on March 12, 2023, the Main Directorate of the PFU in the Nikolaev area was made a decision to grant a subsidy in non-cash form, opened with the bank, to cover the costs of housing and communal services from February 1, 2024 to December 31, 2024, the total amount of 2024.
As a result of the verification, which took place on May 21, 2024, it was found that the woman acquired real estate for the amount exceeding 50 thousand hryvnias (according to the Ministry of Justice), the type of object-a residential building, the date of registration 2024-01-09, the type of document-a contract of sale, the date of the purchase 2024-02-13, date of receipt of the Ministry of Justice: 23.01.2024. The State Register of Real Estate Rights contains information about the holding of the ownership of a residential building on January 9, 2024. The woman did not announce the Main Directorate of the Pension Fund of Ukraine in the Nikolaev area about her purchase of real estate. The letter dated June 26, 2024 states that the PFU announced it of the occurrence of a subsidy overpayment with a request to repay the funds received. These circumstances were not refuted by it.
