Currently, the continuation of payment of pensions to persons with disabilities is made on the basis of extracts from expert decisions commissions received through electronic information interaction. The Pension Fund of Ukraine informs about it.
According to subparagraph 14-6 of Section XV “Final Provisions” of the Law of Ukraine dated 09.07.2003 No. 1058-IV “On Compulsory State Pension Insurance”, for persons with disabilities and children with disabilities who are assigned a disability pension or in connection with a pension of Re -inspection or evaluation of daily functioning for the reasons determined by the Cabinet of Ministers of Ukraine, the payment of a pension for these categories shall continue until the date of re -inspection or within six months from the moment of termination or abolition of martial law (for persons called for military service on the conscript during the mobilization.
The category of those who cannot be sent to evaluate daily functioning include:
Persons with disabilities among the military personnel of the Armed Forces and other formations created in accordance with the legislation of Ukraine, as well as law enforcement agencies with law enforcement functions, as well as persons of the rank and file of the civil protection service, disability and degree of loss of professional capacity (percentage) (service) or before the date of evaluation of the daily functioning of the person.
According to part 3 of Article 35 of the Law of Ukraine of 09.07.2003 № 1058-IV “On Compulsory State Pension Insurance”, if the payment of a pension to a person with disabilities was suspended due to health recovery or if it did not receive a pension due to not re-examined for a person. Disability pension Disability pension is assigned to persons who have been disability. Depending on the degree of disability, three disability groups were identified. The reason, the group, the time of disability, the term for which it is set is determined by the body of assessment of the daily functioning of the person.
The amount of disability pension is calculated in accordance with the disability group as a percentage of retirement by age:
- 100 % of age pensions – persons with disabilities of group I;
- 90 % of age pensions – persons with disabilities of group II;
- 50 % of age pensions – persons with disabilities of group III.
At the same time, the period from the date of work during the years of work is counted towards the insurance period for the calculation of the amount of the pension by age, which determines the amount of the disability pension, in addition to the insurance period from the date of establishment of disability to 60 years of age.
Disability pension shall be assigned from the moment of disability, if the application for a pension is submitted not later than three months from the moment of disability. If the application for a pension is submitted later, the pension is appointed from the date of appeal for it.
Disability pension is set for the entire period for which the disability is prescribed. Persons with disabilities who have reached retirement age under the law are assigned to a disability pension during their lives. Re -inspection of these persons with disabilities is carried out only on their initiative.
For persons with disabilities who are assigned a disability pension or pension due to the loss of a breadwinner whose term of suspension of payment of such a pension is at the duration of martial law or state of emergency in Ukraine, in case of impossibility to undergo a re -inspection, payment of a pension continues until the termination or cancellation of the state of war, In connection with the mobilization, in a special period or admitted to military service under the contract during the martial law – not less than for the entire term of their military service).
In the event that a person with a disability is re -examined by another group (subgroup) of disability, the amount of the pension extended in accordance with this Regulation shall be reviewed from the month following the month of receipt of the conclusion of the evaluation body of the daily functioning of the person to the territorial body of the Pension Fund.
