The woman demands from the Pension Fund for compensation for an unpaid pension of the deceased father in the amount of UAH 80 715

The citizen appealed to the court with the request of PFC’s recovery the funds that her father did not receive for life. The total amount of the claim is 80 715 UAH. The relevant data are contained in the decision of the Bohun District Court of Zhytomyr, published on September 10, 2025.

The deceased father initiated a court case against the GU PFU in the Zhytomyr region. According to the Resolution of the Zhytomyr District Administrative Court in Case No. 240/2829/22, the institution was obliged to charge and pay additional pension accruals as a non -operating pensioner living in radioactively contaminated territory from 01.08.2021. The amount of the surcharge was determined in accordance with Article 39 of the Law of Ukraine “On the Status and Social Protection of Citizens Affected by the Chornobyl Disaster” of 28.02.1991 No. 796-XII and equal to the double minimum wage. After the death of the PFC man, he recalculated for the period from 01.08.2021, recognizing a debt of 161 430 UAH, which remained unpaid. The court order confirmed that the heir of 1/2 of the property of the property was recognized as the daughter of the deceased, which was certified by the certificate of the Ovruch State State Administration. Earlier, she had already received half of the amount due to the decision of the Bohun District Court of Zhytomyr in case No. 295/14937/24. PFU representatives suggested appealing the issue of payment of the rest of the funds in court.

What decision did the court make? The court satisfied the plaintiff’s claims. In favor of a woman from the State Pedagogical University, 80 715 hryvnias were charged in the Zhytomyr region as an unattached part of the pension payments that belonged to her father. This amount is calculated on the basis of the decision of the Zhytomyr District Administrative Court dated 15.06.2022 in Case No. 240/2829/22.

“The plaintiff filed an appeal on the inheritance after the death of his father. As an heir, who issued the right to the share of property by the will and confirmed this by the certificate of the Ovruch State State Administration of 16.06.2025 №1127/02-14, it has the legal grounds for the right of a pension. The arguments of the PFC on the defendant’s insignificance were rejected by the court: the institution was openly funded through the State Treasury, it was the pension accrual and had to execute the court’s decision of 15.06.2022 on additional payments to the pensioner.
