The government wants to strengthen the punishment for the illegal border crossing: DPSU explained the detailsThe SSSU said that violators often try to damage the fence on the border / photo of UNIANThe bill on strengthening responsibility for the illegal crossing of the state border, which the Government of Ukraine submitted to the Verkhovna Rada, provides a procedure that accelerates the punishment for violation and damage to engineering and technical structures. The spokesman of the State Tax Service of Ukraine Andriy Demchenko told about it on the air of the telecast.

According to him, attempts to cross the border do not stop, violators are constantly delayed, the corresponding criminal schemes are exposed. Demchenko noted that the said bill, which was developed together with the SSSU, increases the responsibility of not only organized criminal groups, but also those citizens who use their “services” or try to cross the border illegally. The spokesman explained that the strengthening of criminal liability provides for Art. 332 of the Criminal Code of Ukraine for persons trying to “bypass” the checkpoint of the DPSU in martial law, using counterfeit documents or destroying border infrastructure.

“Quite often, violators try to damage the CCTV system, engineering, technical means used by border guards … For example, a fence that is located directly on the border line,” Demchenko said.

According to him, the bill also adds a new rule to violate the time limits outside Ukraine – it is proposed to be responsible for this on conscripts who go abroad.

“I would like to point out that the amendments are also provided for in the Code of Administrative Offenses for an attempt, or the illegal crossing of the state border of Ukraine. In fact, administrative protocols will be able to consider the SPSU bodies, that is, border units, not courts, as it is as of now. It will facilitate the prosecution.

Criminalization attempts to illegally cross the borderWe will remind, the Cabinet of Ministers of Ukraine submitted to the Verkhovna Rada a laws 13673 “On amendments to the Code of Administrative Offenses, the Criminal Code of Ukraine, the Criminal Procedure Code of Ukraine and other laws of Ukraine on liability for offenses related to the intersection of the state border of Ukraine”.

The project provides changes in a number of articles of criminal and administrative codes. In particular, to establish criminal liability for the illegal crossing of the state border in the conditions of military or state of emergency outside the checkpoints across the state border (part four of Article 3322 of the Criminal Code of Ukraine). And also – for obstruction of border infrastructure, damage or destruction (Article 3323 of the Criminal Code of Ukraine) and violation of the conscript, conscript or reserve of the established term of stay outside Ukraine (Article 3371 of the Criminal Code of Ukraine).
