It is about two projects: №13420 “On amendments to the Tax Code of Ukraine and other laws of Ukraine on the support of enterprises of the defense-industrial complex” and №13421 “On amendment to section XXI” Final and Transitional Provisions of the “Customs Code of Ukraine on supporting enterprises of the defense and industrial complex.
“The text, which is presented for the second reading, takes into account the proposals of the industry and eliminates the majority of risks that were in the previous version,” the Ukrainian Weapons Council said.
The main changes were described here between the first and second reading of Bill No. 13420. For example, in the first reading, the basic rules were included in the Tax Code and other legislative acts. And already in the final version for Defense City provides a separate section in the Law “On National Security of Ukraine”.
The Ukrainian Weapons Council explained that this allows you to clearly define the key concepts, the order of acquisition and loss of resident status, as well as the mechanisms of implementation of the regime. The responsibility for monitoring compliance with the requirements and keeping the register is entrusted to the Ministry of Defense.
Another changes apply to income requirements. Qualified income has been established and its threshold is reduced from 90% of net income to 75% of qualified. For aircraft enterprises there is a separate indicator – 50%. The Ukrainian Council has noted that this opens the Defense City regime for more companies.
In addition, there was a clear definition of qualified income and expanded the list of defense goods that are subject to mode. There was also a full register of residents.
“It will provide reliable data protection, an orderly accounting system and the possibility of prompt receipt of information. The Register of the Register is determined by the Ministry of Defense, and the procedure for its maintenance will be approved by the Cabinet of Ministers,” the statement reads.
At the same time, there is a possibility of simultaneous residence in City and Defense City. However, in this case, the company will not be eligible for Defense City tax benefits.
Additional changes – cancellation of the rule on the mandatory payment of land and environmental tax and real estate tax after leaving the legal regime. Income tax is not paid subject to reinvestment.
Among other things, the mandatory condition of relaxation to gain a resident status has been abolished-it has become voluntary. Also, the final version preserves key provisions that provide additional protection of data on defense enterprises.
The Ukrainian Council of Weapons stated that after familiarization with the final version, they do not have critical comments on the concept.
