Low penalties: The Accounting Chamber criticizes the Antimonopoly Committee’s activities

In 2024, the revenues to the state budget from the penalties and penalties imposed by the Antimonopoly Committee of Ukraine (AMCU) were significantly reduced.

According to the Accounting Chamber, which analyzed the AMCU report this year, the Committee imposed fines totaling UAH 1.02 billion, but only UAH 59.2 million was actually paid – less than 6% of the amount.

At the end of the year, unpaid penalties amounted to UAH 15.1 billion, of which UAH 8.1 billion – by decisions appealed in courts.

One of the reasons for low revenues is the current rule of law, which provides for automatic suspension of the AMCU’s decision during its appeal.

The Accounting Chamber also notes that the AMCU has not been able to properly substantiate and confirm the economic effect of its activity – it is estimated at UAH 6.3 billion. This amount is determined on the basis of a fixed ratio of 5% of the respective market that does not have international or scientific confirmation and is an internal regulatory approach of the committee.

In addition, the AMCU’s report does not have systematic information on the imposition and penalties: there are no data on unpaid penalties, as well as the reasons for their non -payment or cancellation.

Although the structure and terms of submission of the report mainly meet the requirements, its content does not give a full idea of the real results of the AMCU’s activity and the state of performance of certain functions, said the member of the Accounting Chamber Gennady Plis.

He also reported that the Committee did not approve the plans of activity for 2024 and in the medium term, and some of the priorities remained unfulfilled without explanation.

According to the results of the analysis, the Accounting Chamber approved the AMCU report for 2024 on the implementation of the state budget at its meeting.

The competition for the management of the arrested assets of the Russian General Valery Kapashin in Poltava with a total value of more than UAH 800 million is ongoing. Assets include non -residential premises, public buildings and land of more than 2000 sq.m.
