Stephanyshina about the ECtHR decision on the Russian Federation: “In none of the previous conflicts there was such a unanimous condemnation”

Commenting on the ECtHR’s decision in the Ukraine-Internal Agreement against Russia, Viceremierk, Minister of Justice of Ukraine Olga Stephanyshyn states that in none of the previous conflicts there was such a unanimous condemnation by the international community of flashy neglect to the principles of international law order, established after the Second World War.

According to her, the court found that the military attacks of the Russian forces in the sovereign territory of Ukraine from May 11, 2014 to September 16, 2022 were strategically planned for deliberate purpose and undeniable result – the establishment of power and control over territories, infrastructure and the population.

“It is worth explaining here. In March 2022, Russia was expelled from the Council of Europe due to a full -scale invasion of Ukraine. However, the exclusion of Russia as a member does not mean that from the same day the Convention for the Protection of Human Rights has ceased to operate. The Convention contains an important norm: with the exclusion of a state from the Council of Europe, the Convention continues to operate for it for six months. Therefore, the ECtHR established a violation by September 16, 2022 – the moment of the final termination of the Convention for Russia, ”the minister explained.

According to Stephanyshyn, this does not mean that after this date, Russia is released from liability for further crimes – simply the ECtHR has lost jurisdiction to consider events after September 16, 2022, and there are other international legal mechanisms to hold the aggressor for later violations.

On July 9, the European Court of Human Rights made two decisions against Russia, which states that the Russian Federation has violated international law in Ukraine. This is the first time since the full -scale invasion in 2022, when the International Court found Moscow responsible for human rights violations.

The court also ruled that Russia was involved in the MH17 flight. This is the first time the International Court found Moscow responsible for the 2014 tragedy in the sky over the Donbass.

Earlier, Ukraine and the Netherlands have filed four lawsuits against Russia against Russia, covering a wide range of probable human rights violations from the beginning of the conflict, including the beating of the Malaysian Airlines and the abduction of Ukrainian children.
