It is noted that on May 9, the Kharkiv Kyiv District Court adopted a verdict in the case of concealing a crime related to a fatal traffic accident that occurred in February 2022 on the route “Kiev – Kharkiv – Dovzhansky” with the participation of the cotton of businessman Alexander Yaroslavsky.
According to the Judiciary, two men – residents of Ukrainian cities (Donetsk region) and Dergachi (Kharkiv region) became involved in the case. They were found guilty of trying to hide the circumstances of an accident, which resulted in a pedestrian.
The investigation found that on February 9, 2022 at 22:55 the employee of BADM LLC, a Ukrainian native, while driving the Mercedes-Benz G-63 AMG, moved the highway at a speed of 113 km/h.
On a wet section of the road, he ran into a pedestrian, which in dark clothing without reflective elements was in a semi -sitting position. Without stopping, the driver continued movement, leaving the scene without assisting the victim.
The pedestrian died on the spot. The examination recorded numerous injuries: fractures of the skull, spine, ribs, pelvic bones, as well as ruptures of vital organs – hearts, lungs, liver, spleen and kidneys.
Understanding the seriousness of the consequences, the driver at 23:21 contacted the native of Dergach, Alexander Berezhny and asked to bring another car – Porsche.
Between 00:25 and 00:34, February 10, Berezhny passed the accident where the police were already working. He learned about the death of man near the gas station.
At 01:20 he arrived in the Mercedes driver, who briefly announced the accident without specifying the results and suggested that he guilty. The coastal agreed.
On the morning of February 10, at about 09:30, he, together with a lawyer, addressed the police, saying that he was driving at the time of the accident. According to him, he moved at a speed of 100 km/h, felt a blow, stopped in 100-150 m, inspected the car, but, not found anything, decided that he knocked down the animal, and went on.
However, the investigation found that Berezhny was not a Mercedes-Benz driver at the time of commissioning, so he was abolished.
The court found both men guilty of concealing a serious crime (Part 4 of Article 27, Part 2 of Article 28, Part 1 of Article 396 of the Criminal Code of Ukraine). The driver was also tried for leaving the victim in danger (Part 1 of Article 135 of the Criminal Code of Ukraine), but due to the limitation period, he was released from liability under this article.
The defendants pleaded guilty and repented. The court appointed them three years in prison conditionally with a term of one year.
Among the additional obligations: regularly arrive in the probation authority, report a change in place of residence or work and not travel abroad without permission. In addition, prisoners have to pay UAH 275 578.84 to cover the cost of forensic examinations.
The sentence may be appealed in the Kharkiv Court of Appeal for 30 days.
Oleksandr Yaroslavsky is one of the richest Ukrainians, the owner of DCH. It ranks 9th in the TOP-100 richest Ukrainians, according to the Ukrainian Forbes for 2021 with capital of $ 820 million. The President of Metalist Football Club in 2005-2012 was an investor in the Euro 2012 Championship in Kharkiv.
The accident caused widespread resonance. On February 10, 2022, Yaroslavsky flew to London that his company was called a planned trip. The Prosecutor General stated that they tried to hold a person who was not at the scene of the accident, which was why the police chief of Kharkiv region lost his position.
Investigation attempts to falsify the State Bureau of Investigation (DBR), and the case was transferred to the Chief Investigative Department of the National Police under the procedural guidance of the Attorney General’s office.
Kateryna Ovcharenko, the ex -wife of the deceased and the mother of their common child, demanded that the perpetrators be held accountable and compensation for the harm.
The deadly accident occurred on February 9 on the Kyiv – Dovzhansky highway. The car moving from the city of Chuguev in the direction of Kharkiv committed a pedestrian, causing him to die. At the scene of an accident, they found a license plate that belongs to Alexander Yaroslavsky.
Yaroslavsky himself left Ukraine (he flew to the United Kingdom). Police are investigating the death of the pedestrian, and the businessman was called for questioning – as a possible participant in the accident.
