The Verkhovna Rada continued the possibility of voluntary return to service after the HCP by the end of the summer

The Verkhovna Rada adopted an important law that allows servicemen who left unauthorized parts (“HSC”) or deserted, voluntarily return to service by August 30, 2025. The Verkhovna Rada adopted an important law that allows servicemen who left unauthorized parts (“HSC”) or deserted, voluntarily return to service by August 30, 2025.

282 MPs voted in favor of the corresponding bill.

The document makes changes to the order of military service in certain categories of servicemen during the action of martial law, creating a simplified mechanism for returning to service without immediate criminal liability.

According to the new law, during the martial law, the military service of persons who have left part is not suspended. If they do not return to the time of termination or abolition of martial law, the service will be suspended from the next day.

It is important that the absence of such military is not credited to years of service, and payments, security and benefits are not granted. This also applies to their families – at the time of absence, they also lose the right to benefits and compensation.

The mechanism of voluntary return implies that a returned serviceman can continue his service at the decision of the commander, even in the case of open criminal proceedings. From the moment of renewal of the service for such persons, all social guarantees and benefits provided for by the legislation of Ukraine are restored.

This gives a chance to those who have left part of different reasons, return to the duties without immediate persecution if the commander supports such a decision.

The law also provides for the abolition of the Institute for Suspension of Military Service for military who left unauthorized or deserted during martial law. In fact, this allows you to return such servicemen to perform duties more promptly without waiting for the court to be exempted from criminal liability.

At the same time, if the military does not take this opportunity by August 30, 2025, his service will be suspended and the issue of responsibility will be resolved in the usual manner.

Recall that from March 1, 2025, an updated algorithm for military personnel to return after HRC or desertion began to operate.

We also reported that the Ukrainian Ministry of Defense explained that not all servicemen who have left part of (HCR) could return to the simplified procedure service. It depends on the date they left part and provides a different recovery procedure.
