According to the 1976 emergency law, the US President has the right to declare an emergency at any time and for almost any reason-without having to prove a specific threat or receive Congress approval.
At the same time, in 1983, the US Supreme Court actually deprived Congress the ability to veto a state of emergency.
As Axios notes, Trump’s use of power to declare emergencies is unprecedented for US history and testifies to the intention to focus power in the White House.
