The Donald Trump administration appealed to the US Supreme Court to cancel court prohibitions that block the Presidential Decree on the cancellation of the right to citizenship under birth. Earlier, the courts in three states blocked the initiative, recognizing it contrary to the Constitution.

Details: The decree signed by Trump on the first day of his presidential post, stipulates that the right to US citizenship should not extend to children born in the country from non-alien parents or persons who are in temporary visas.

However, the courts of Meriland, Massachusetts and Washington recognized this initiative unconstitutional and blocked it, referring to the 14th amendment to the US Constitution. It guarantees that all persons born or naturalized in the United States and fall under their jurisdiction are US citizens and the state in which they live.

The Trump administration filed a petition with the Supreme Court demanding to unlock the decree. Acting Prosecutor General US Sarah Harris stated that the states at the state’s level “went too far” and called on the Supreme Court to cancel their decisions.

“These cases raise important constitutional issues that have serious consequences for border security,” Harris said in her submission.

In her opinion, judicial prohibitions may not concern all born in the United States, but only specific persons under the jurisdiction of these courts.

The US Department of Justice insists that the implementation of Trump’s decree is part of the broader efforts of the administration to reform the immigration system and respond to the crisis on the southern border.

More than 22 states and organizations for the protection of immigrants have already filed claims, demanding that Trump’s decree finally block, claiming in court filings that the executive order is unconstitutional and “unprecedented”.

Reference: Trump’s decree, signed at the beginning of his second term, provided for refusal to recognize citizenship for children born in the United States from parents who are in the country illegally or have a temporary status.

The Trump administration claims that non -citizens are not subject to US jurisdiction and therefore are not entitled to citizenship. However, the 14th amendment, ratified in 1868, was aimed at providing citizenship for the former slaves and their descendants, and since then guarantees citizenship to all born in the United States.
