The Parliamentary Committee on National Security and Defense is considering an extension of the term of the VLK for those with limited fitness. For this purpose, they plan to make appropriate changes to the law. However, they will be approved no earlier than February 5 – that is, when the opportunity to pass the VLK ends, as provided for by the law. Committee member from “European Solidarity” Iryna Friz told about this in a comment to Radio Liberty.

“This issue was raised at the committee. Corresponding changes are being prepared. But so that you understand: the next meeting (VR – ed.) will take place already in February. And therefore, it will be necessary to provide in the transitional provisions that for the time being, while this next change with the extension of the term will be implemented, so that people will not be subject to administrative responsibility, ”says Friz.

The exact terms for which it is planned to extend the passing of the VLC for those with limited fitness are currently unknown, the deputy specified. But, according to Freez, “without qualitative reform of the VLK system, the extension of terms may last several more times.”

“Unfortunately, during the consideration of this draft law, it seems that in April of last year we were assured by both the Ministry of Health and the Ministry of Defense that this term would be enough for everyone to have the opportunity to go through and renew their status,” she emphasized Frieze

Earlier, the deputy head of the President’s Office, Iryna Vereshchuk, reported on the social network that today more than 1 million people with limited fitness have not yet passed the appropriate medical examinations. Including because they did not receive calls to the VLK, or they cannot receive them in the TCC due to queues. Therefore, it is unrealistic to let such a large number of people through the VLK before February 4, she stated.

February 5 coincides with the deadline until men with the status of “limited fitness” had to undergo a repeat VLK. The TCC publicly insisted that men should personally come to the recruitment centers and take referrals to the VLK. Instead, lawyers, referring to the norms of the law, claim that the initiative here should be the TCC – that is, the recruitment centers should direct the medical examination. In the event that a person with the status of limited suitability does not pass a repeated VLK by February 5, he will face a fine.

Lawyer Anton Sintsov explained the situation as follows in a commentary on Radio Svoboda:

“Actually, a situation has really arisen where one thing contradicts the other. What is this connected with: the fact that the law provides that persons with limited fitness or conscripts with the status of limited fitness need to pass a repeated military medical commission. This very phrase, that they are subject to passing, is not binding. Accordingly, in order to understand how this should happen, we take a deeper look into Resolution No. 560, which clearly stipulates the procedure: by the decision of the head of the TCC, a conscript is sent to undergo the VLK. Therefore, in principle, given the way it is prescribed, everything should be carried out not on the initiative of the conscript, but in fact by the decision of the head of the TCC, after which there should be a package of documents: either a summons that records the decision to pass the VLK, or if the person appeared, then a referral is submitted for passing the VLK”, – Anton Sintsov, an adviser of the Asters law firm, explained to RFE/RL.

Along with that, the lawyers emphasize that “there is also another provision in the legislation, which states that the VLK during martial law is valid for only one year.”
