Details: According to the message distributed on Wednesday evening, as part of the investigation of the criminal proceedings regarding the negligence of the commanders during the defense of part of the territory of the Lipetsk rural territorial community of the Kharkiv district, it was found that the ex-commander of the “Kharkiv” OTU did not correctly assess the potential of the enemy and the situation in the area of responsibility and by his actions, he also contributed to the voluntary abandonment of the battlefield by the fighters of the 125th Infantry Regiment.

It was established that the military commander ignored the available intelligence, assessed the Russian offensive in this area as “unlikely” and accordingly gave orders and orders to subordinates that did not correspond to the real situation, which ultimately led to tragic events on the front line.
Due to miscalculations in the command and the arbitrary departure of soldiers and certain units of the 125th Infantry Regiment, the strategic initiative was lost, and the enemy managed to penetrate the brigade’s defense line to a distance of up to 10 km, which allowed them to shell Kharkiv again with artillery.
Also, as a result of such actions, almost a hundred Ukrainian servicemen were wounded, killed, or went missing on the first day of the enemy’s offensive.
It is noted that Galushkin will be charged with suspicion under Part 5 of Art. 27 of Article 429 of the Criminal Code of Ukraine (Assistance in voluntary abandonment of the battlefield or refusal to act with weapons).
In his turn, lawyer Velichko emphasized that the defense considers such actions of law enforcement officers to be “unethical arbitrariness”. According to him, Galushkin felt sick, an “ambulance” was called for him.
The direct speech of Velichka: “They (DBI employees – ed.) did not hand him a new suspicion. They only read that he was being detained. I believe that he was detained without grounds, arbitrarily and unethically.
They were detained in the same case, but under other articles – 427 (surrender of the forces entrusted to the enemy by the commander, leaving to the enemy fortifications, military equipment, etc. – ed.) and 429 (voluntarily leaving the battlefield during the battle or refusing to use weapons during the battle – ed.). But it’s still the same episode, they just broke it up.
We are talking about war crimes, but where did you see the knowledge of the investigation of war crimes in the guys from the SBI? These are specific crimes. And they were given a tip, and what do they do: 12 people attacked a woman, a wife (Galushkina – ed.) and a person who uses one hand after surgery.
They do not try to comply with the court order. We posted bail and the individual tried to get himself in order to cooperate with investigators and learn the truth.
We called the ambulance again because he felt sick, he hadn’t eaten for three days. In fact, he was not given medical care. I am waiting for them to let me in.”
What preceded: The Pechersk District Court of Kyiv chose a preventive measure in the form of arrest with an alternative bail of 5 million hryvnias to the former commander of the operational-tactical department of “Kharkiv”, Brigadier General Yury Galushkin.
The fifth president, Petro Poroshenko, announced his intention to post bail for Galushkin. Later, he reported that another legal entity had already paid the required amount. The name of the mortgagor has not been disclosed at this time.
