“As part of the investigation of the criminal proceedings regarding the negligence of the commanders during the defense of a part of the territory of the Lypetsk rural territorial community of the Kharkiv district, it was found that the ex-commander of the OTU “Kharkiv” incorrectly assessed the potential of the enemy and the situation in the area of responsibility and by his actions also contributed to the voluntary abandonment of the battlefield by the soldiers 125th Separate Territorial Defense Brigade.
It was established that the military commander ignored the available intelligence, assessed the Russian offensive in this area as “unlikely”, and accordingly gave orders and orders to subordinates that did not correspond to the real situation, which ultimately led to tragic events on the front line.
Due to miscalculations in the command and the arbitrary withdrawal of soldiers and certain units of the 125th Separate Territorial Defense Brigade from their occupied positions, the strategic initiative was lost, and the enemy managed to penetrate into the brigade’s defense line at a distance of up to 10 km, which allowed him to shell Kharkiv with artillery again.” according to the message of the SBI.
The investigation states that Galushkin will be charged with suspicion under Part 5th century 27, Art. 429 of the Criminal Code of Ukraine (assistance in voluntarily leaving the battlefield or refusal to act with a weapon).
Earlier on January 22, lawyer Mykhailo Velychko reported that a bail of five million hryvnias was made for the former commander of the operational-tactical department of “Kharkiv”, Brigadier General Yuriy Galushkin.
Previously, the fifth president, Petro Poroshenko, said that he wanted to post bail for Galushkin, whom he “knows well from the defense of Kyiv in the winter of 2022.”
“General Yury Galushkin’s lawyers have just informed that another legal entity contributed the necessary funds for bail,” Poroshenko wrote on Facebook.
On January 21, the court chose a preventive measure for Yury Galushkin in the form of detention with the alternative of posting bail in the amount of five million hryvnias.
On January 20, Yuriy Galushkin, ex-commissioned officer of the 125th brigade of the TrO Artur Horbenka, former commander of the 415th battalion of the 23rd OMBr Ilya Lapin were detained on the charge that they “did not provide adequate protection of Kharkiv Oblast during the enemy’s offensive in May 2024.”
Investigators state that “the officials did not prepare the defense of the border regions of Kharkiv Oblast and lost control of the battle during the repeated attack of the Rashists on the regional center.”
