On Monday, US President Donald Trump signed an executive order declaring that the federal government’s policy is to recognize only “two genders, male and female,” eliminating the ability for Americans to mark “other” or “X” on federal forms. The decree also changes the way the federal government recognizes gender identity.

Donald Trump has long promised to change the federal government’s approach to gender identity, and during the election campaign his remarks about not allowing transgender athletes to participate in women’s sports caused the loudest reaction from supporters of his election campaign.

Immediately after taking office on Monday evening CET, Trump said he wanted to issue a decree that the new US government in Washington would recognize only two genders, namely men and women.

Across the country, ideologues who deny the biological reality of sex are increasingly using legal and other means of social coercion to allow men to self-identify as women and gain access to intimate single-sex spaces and activities designed for women, from shelters for domestically abused women violence, to women’s showers in the workplace.

The gender executive order stated that the federal government should not use terms such as gender identity, instead using sex assigned at birth.

“Federal funds must not be used to promote gender ideology. Each agency must evaluate grant conditions and grantee preferences and ensure that grant funds do not promote gender ideology,” the decree states.

The order contradicts claims by transgender Americans, who say they are trying to use spaces that match their gender identity rather than “access intimate single-sex spaces and events designed for women.”

From a legal point of view

Thomas Berry, director of the Cato Institute’s Center for Constitutional Studies, said the executive order is broad in scope, but some aspects of it could conflict with the Supreme Court’s 2020 decision.

In Bostock v. Clayton County, Georgia, the Supreme Court ruled 6-3 that it is illegal to fire an employer because he is gay or transgender.

“It’s such a sweeping executive order. I think some of it he has the authority to do, and some parts of it will be more controversial. So one thing that immediately strikes me, and I wonder, is how much he’s going to try to go against the Supreme Decision Bostock case over the past five years, where the Supreme Court clearly ruled that the Civil Rights Act of 1964 applies to both sexual orientation and gender identity and discrimination So it’s a law that’s up to the Supreme Court to interpret, and the Supreme Court has made a binding decision,” Berry said of Mr. Trump’s actions.
