The Commercial Court of the city of Kyiv issued a decision according to which LLC “Ukr Gas Resurs” should recover 684,000 in favor of the Zvyagel apartment and operating unit of the Ministry of Defense of the Zhytomyr region. According to the terms of the contract concluded in February 2021, Zvyagelsk KEC ordered 6.5 million kWh of electricity for UAH 12.5 million, which was UAH 1.92 per 1 kWh. However, in the future, several additional agreements were signed, according to which the price increased to UAH 2.75 per kWh. The court established that this increase exceeded 10%, which is a violation of the legislation of Ukraine in the field of public procurement.
Changes to the contract were made on the basis of the price certificates of the Kharkiv Chamber of Commerce and Industry, but the court found that these certificates do not confirm fluctuations in electricity prices, but only reflect the weighted average price on the market. Therefore, the court recognized these certificates as invalid and charged Ukr Gas Resurs the unreasonably received funds.
LLC “Ukr Gas Resources” is owned by Andriy Kuchkov, the son-in-law of ex-Minister of Ecology Mykola Zlochevskyi.
