Details: The letter states that the Ministry of Defense has developed a draft law on improving rotation mechanisms, determining the procedure and conditions for dismissal from service for certain categories of military personnel during martial law.

Among other things, the document provides for the establishment of new norms regarding the dismissal from service and the rotation of servicemen who have been performing tasks for a long time in the areas of hostilities.

The draft law was sent for approval to the General Staff of the Armed Forces of Ukraine and the Administration of the State Special Transport Service.

The General Staff of the Armed Forces of Ukraine did not support the relevant project of the law, arguing that its submission to the Supreme Court is possible only on the condition that a sufficient number of military-trained resources are accumulated on military records in the TCC and SP and citizens are recruited to serve in the Armed Forces in satisfactory volumes.

Verbatim from the letter: “According to the information provided by the General Staff, in the event of the implementation of the project of this law, the estimated number of servicemen who will have the right to be dismissed will be 108,000 people (including 14,000 officers), which, in the event of their simultaneous dismissal, will lead to a significant reduction in the number of personnel combat units”.

More details: At the same time, the letter states that the Ministry of Defense has developed two alternative versions of the corresponding draft law. In particular, it is proposed to provide military personnel who during martial law served continuously for 36 months and during this period took part in hostilities, being in the areas of their implementation, for at least 18 months:

  • referral for rehabilitation for up to two months, and after its completion – provision of an additional one-time leave for a period of 30 days with maintenance of monthly financial support;
  • provision of an additional one-time vacation for a period of 90 days with maintenance of monthly financial support.

Also, these alternative options propose to oblige the commanders to conduct rotations of the military, who have been directly participating in hostilities for 90 days.

Verbatim from the letter: “The specified alternative draft laws require a detailed discussion and the adoption of an appropriate decision at the level of the state leadership. In view of the above, we ask that the deadline for the implementation of the task defined by subsection 1.40 of Plan 3633-IX (it concerns the development of a draft law on the conditions of demobilization – UP) be postponed until March 18, 2025 year”.

Prehistory:

  • On April 11, the Verkhovna Rada adopted the law on mobilization.
  • At the initiative of the Commander-in-Chief of the Armed Forces of Ukraine Oleksandr Syrskyi, the provision on the release of military personnel from service was excluded from the document.
  • The Verkhovna Rada obliged the Ministry of Defense to develop a draft law with relevant regulations within 8 months.
  • On November 14, Secretary of the Verkhovna Rada Committee on National Security, Defense and Intelligence Roman Kostenko told “Ukrainian Pravda” that the Ministry of Defense plans to complete work on the draft law on determining the procedure and conditions for the release of servicemen from service by December 18, 2024.
