In particular, fines of up to 1,700 hryvnias are provided for staying in public places.
The draft law, which was registered with the Verkhovna Rada under number 12354, provides for adding a new Article 210-2 to the Code of Ukraine on Administrative Offenses. Government officials propose to establish administrative responsibility for violating the requirements of a special legal regime – martial law, introduced in Ukraine or in some of its localities.
In particular, it is proposed to establish responsibility for violation of entry (entrance), stay in populated areas from which general mandatory evacuation is carried out, in the absence of specially issued passes or certificates, as well as for violation of curfew by citizens (prohibition of staying at a certain period of the day on the streets and in other public places without specially issued passes and certificates).
In addition, amendments to Article 262 of the Code of Ukraine on Administrative Offenses are proposed to grant the police the right to conduct administrative detention of violators.
It should be noted that the relevant draft law is already registered on the website of the Verkhovna Rada. But its text is currently unavailable for review.
We will remind that People’s Deputy of Ukraine Oleksiy Goncharenko announced on Telegram on December 20 that the government approved a draft law that provides for the introduction of separate administrative responsibility for curfew violations. Thus, for staying in public places during the prohibited time without a pass, a fine of 50 to 100 of the tax-free minimum income of citizens, i.e., from 850 to 1,700 hryvnias is provided.
He noted that a fine of 30 to 50 non-taxable minimum incomes of citizens, i.e. from 510 to 850 hryvnias, is provided for violating evacuation rules, entering or staying in settlements where mandatory evacuation is carried out, without special permits.
At the same time, fines will not be applied to people who go to shelters, provide medical (pre-medical) aid or accompany the wounded and seriously ill, carry out evacuation or rescue of property and in other cases of threat to citizens’ lives.
Liability for violation of curfewAs UNIAN reported, in May 2024, the Verkhovna Rada of Ukraine already failed a similar draft law on the introduction of administrative responsibility for citizens violating the curfew.
Only 190 deputies voted for the draft law on amendments to the Code of Ukraine on Administrative Offenses and other laws on establishing administrative liability for violation of requirements or non-fulfillment of certain measures of the legal regime of martial law (No. 10195), and a minimum of 226 votes is required.
Citizens were offered fines in the amount of 8 thousand. 500 to 17 thousand UAH Businesses for curfew violations, according to the proposals, would have to pay a fine in the amount of 51 thousand. up to 102 thousand UAH
