The commercial court of the city of Kyiv collected UAH 716,000, which the state enterprise did not pay for grain harvesting, from the State Enterprise “Konyarstvo Ukrainy” in favor of “Elkaro Holding” LLC. This is evidenced by the court decision of November 18. In July 2022, “Dnipropetrovsk Stud Farm No. 65” of the state-owned enterprise “Konyarstvo of Ukraine” concluded an agreement on agricultural works with LLC “Growth Capital Active”. The parties agreed on the preliminary price of harvesting winter cereals for 400 hectares – 640 thousand UAH, harvesting cereals for 50 hectares – 80 thousand UAH. Advertising: According to the acts of services provided: the cost of the service for harvesting wheat (110 hectares) – 176 thousand UAH, the cost of the service for harvesting: oats (295 ha) – 472.8 thousand UAH, the cost of harvesting services: spring barley (42 ha) – UAH 67.2 thousand. According to the turnover and balance sheet, “Dnipropetrovsk Horse Farm No. 65” had to pay UAH 716,000 to Rost Capital Active LLC. However, the branch of the state-owned enterprise did not make timely payment for the services provided. At the end of 2022, Rost Capital Active and Elcaro Holding LLC (the new creditor) entered into an agreement on the assignment of the right of claim (assignment agreement). “Elcaro Holding” appealed to the court with a claim for the recovery of funds.Advertisement: The court rejected the argument of the branch of the state-owned enterprise against the claim, according to which the specifications for the contract indicate different types of work than in the acts of the performed works, since all the specifications and acts of the services provided contain signature and seal of the customer – branch of “Dnipropetrovsk horse factory No. 65” of SE “Konyarstvo of Ukraine”. The court also decided that the branch’s assertions that SE “Konyarstvo Ukrainy” cannot be a defendant in this case, since the debtor is the branch and not a legal entity, are unfounded. And as a result, he charged UAH 716,000 from “Dnipropetrovsk Horse Stud No. 65” in favor of “Elcaro Holding”. The owner of “Elkaro Holding” LLC from Dnipro is Olga Kuzmina.
