The SBI transferred the case of Ukravtodor Novak to Poland

The State Bureau of Investigation referred the case of the former acting chairman of Ukravtodor Slawomir Novak to Poland. The exhibitor did not comply with the court’s decision and left Ukraine, after which he was arrested for committing a number of serious corruption criminal offenses.

Ukrainian law enforcement officers asked their Polish colleagues to take over the criminal prosecution of a Polish citizen who did not comply with the decision of the Ukrainian courts and left Ukraine.

Slavomir Novak is suspected of intentional non-execution by an official who occupies a particularly responsible position of court decisions and orders that have entered into force, as well as obstruction of their execution (Part 3 of Article 382 of the Criminal Code of Ukraine).

According to the investigation, during 2017-2019, the official deliberately did not comply with the decision of the local and Supreme Courts of Ukraine regarding the reinstatement of the head of the Highway Service in one of the regions and actively obstructed justice. Because of this, fines were imposed on the State Highway Agency, and the ex-driver of “Ukravtodor” was warned of criminal liability for ignoring court decisions.

At the beginning of September 2019, the executive proceedings were completed and a notification of the commission of a criminal offense was sent to law enforcement agencies.

In September 2019, the official terminated his powers at his own will, left the borders of Ukraine and returned to Poland, where he was detained for committing a number of serious corruption criminal offenses.

Taking into account the existence of reasons that make it impossible to extradite the official, the SBI, on the basis of the agreement between Ukraine and the Republic of Poland on legal assistance and legal relations in civil and criminal cases from 1993, applied to take over the criminal prosecution. The case materials were transferred in the established order.

The sanction of the article provides for punishment in the form of deprivation of liberty for a term of up to 8 years.

Earlier we wrote that the investigators of the Polish Central Anti-Corruption Bureau searched the former Minister of Transport of Poland and ex-chairman of Ukravtodor Slawomir Novak. Two caches of cash were found at the home of the suspect in the corruption case and the property was seized.

On the basis of the “covid” Law, the Polish Prosecutor’s Office decided to hand over to its border guards the Range Rover car, which was confiscated as part of the criminal case against the former head of “Ukravtodor” Slawomir Novak.

In September 2023, the District Court of Warsaw divided the criminal case against the former head of the Ukrainian State Highway Agency Slawomir Novak.
