Video surveillance of Ukrainians: the state proposes to establish clear rules

On November 20, 2024, the Verkhovna Rada of Ukraine approved draft law No. 8153 on the protection of personal data, which clearly regulates the procedure for video surveillance in public and public places.

The draft law stipulates that video surveillance can be carried out only if it is necessary to prevent crimes or ensure public safety and order, as well as for the purpose of protecting property in buildings or on territories that are in legal possession.

According to the draft law, video surveillance must not be carried out in private residential premises without the appropriate consent of the owners, and is also prohibited in places where a person can expect privacy. Video recordings obtained through video surveillance can be stored for no more than 6 months, and processing of personal data must be carried out only within the limits of legitimate purposes.

The document also stipulates requirements for the transparency of personal data processing in labor relations. Employers are obliged to familiarize employees with the terms of processing their personal data, including the possible use of video surveillance at workplaces. In addition, employees have the right to receive information about the processing of their data and to challenge its validity.

This bill also introduces restrictions on the automatic processing of personal data to make decisions that significantly affect the rights of employees, without their participation.
