The Cabinet of Ministers has made the procedure for reserving persons liable for military service during martial law clearer. This was reported by the Ministry of Energy of Ukraine, UNN reports.

According to the Ministry, starting December 1, reservations for persons liable for military service will again be made through Diia. At the same time, according to the new criteria, all critical enterprises must confirm their status by February 28, 2025.

According to the results of the audit, 95% of all critical enterprises retained this status, but the following violations were found during the audit:

  • a sharp and unjustified reduction in wages for employees after the company has been granted critical infrastructure status; an
  • use of different models to increase the number of bookings overtime;.
  • inclusion of enterprises in the list of critical enterprises that are not essentially critical to the economy.

Deputy Minister of Economy Vitaliy Kindrativ said that “the government was able to identify minor violations and prepare changes to correct them. This means that the new parameters of reservation and criticality of enterprises will become clearer and will ensure a balance between the state’s defense capability and the economy.

Based on the audit results, the enterprises where abuses were detected lost their criticality status, and their employees were disarmed. We have also streamlined the approval of sectoral and regional criteria for the criticality of enterprises. Only those companies that really contribute to the economy and have the legal right to do so should be reserved,

Based on the audit findings, the Government decided to update the booking criteria to make the mechanism work for the benefit of both our defense capability and the economy.

The algorithm for recognizing enterprises as critical has not changed. As before, the company applies to the relevant Ministry or RMA to obtain this status.

The government has retained the eight existing criteria for determining whether an enterprise is critical. At the same time, sectoral and regional criteria for criticality are now agreed upon by the Ministry of Defense and the Ministry of Economy.

For private enterprises, a mandatory criterion is established — the accrued average salary in the enterprise for the last calendar quarter must be at least 2.5 of the minimum wage (20 thousand UAH as of November 15, 2024). The employee who is being booked must also have an accrued salary of at least 20 thousand hryvnias.

A mandatory criterion for companies is introduced – no tax arrears. 

Businesses need to prove their critical importance

Companies that want to book an employee must confirm compliance with the current and new criteria. They have more than three months to do so – from the publication of the relevant resolution until the end of February 2025. 

After confirming the criticality, companies must resubmit the lists of employees for booking through Diia. Until the updated lists are submitted, all bookings provided remain valid. 

Employee booking through Diia will be launched on December 1. The service eliminates the human factor and speeds up the process. 

Businesses are prohibited from booking employees who are not registered for military service or do not have military registration documents. 

 Recall

The President of Ukraine saidthat the economic booking models shown to him are not fair. Zelenskyy instructed the Ministry of Economy and the Prime Minister to find a balance in this matter.
