The court obliged the Fastiv city council (Kyiv region) to carry out the state registration of the right of communal property of the Fastiv city territorial community to the protective structure of civil protection (anti-radiation shelter), which is located at 10 Sadova street.
About this testifies court decision from November 6.
The prosecutor’s office appealed to the court with a corresponding lawsuit. According to her, at the end of 2023, the shelter at 10 Sadova St. was assessed as not ready for its intended use.
At the beginning of this year, the Fastiv district administration of the State Emergency Service of Ukraine in the Kyiv region informed the prosecutor’s office that it had discovered 17 derelict protective structures of civil defense, including one at 10 Sadova Street.
As the court established, until 2021, the five-story building at 10 Sadova St. was on the balance sheet of the KP FMR Fastivska housing and operation office. And three years ago, it was written off from the utility company’s balance sheet.
In Ukraine, protective structures of civil protection of communal property are not subject to privatization or alienation. And even after the city council agreed to write off the building from the balance sheet of the KP FMR Fastivska housing and operation office in 2021, the high-rise building, according to the court, did not fall out of communal ownership.
According to the case materials, the shelter is currently on the electronic record of protective structures of civil protection of the Kyiv region, entered in the information system Accounting and fund of protective structures of civil protection.
Therefore, the court obliged the Fastiv City Council to register the shelter as communal property.
