The Ombudsman of Ukraine Dmytro Lubinets made public the results of an unscheduled inspection of the institution, which was recently conducted by the monitoring group of his office together with representatives of the National Social Service Service and civil society, the Ukrainian Network for the Rights of the Child and the Children’s Voices Foundation, which was based on a complaint about violence against children in a special school.

In particular, the monitoring group recorded the testimony of children and is checking the facts of sexual violence in the institution.

It is noted that the special school does not have a student attendance record system. The administration and teachers do not know how many children should be in class and where they are if they are absent.

In addition, it is said that children are intimidated by placing them in a psychiatric institution for bad behavior, and drugs, including psychotropics and sedatives, are given to pupils without a doctor’s appointment, control and without confirming the diagnosis.

According to the Ombudsman, even in the presence of monitors, the employees of the institution put psychological pressure on the children, insulting and pushing them.

It is also indicated that despite the status of a specialized institution and a large number of children with special educational needs, the school does not have correctional teachers, a speech therapist, a defectologist, a massage therapist, and other specialists whose presence is important for the development of the pupils of the institution, which may indicate a violation of the child’s right to education.

“The children are not provided with the necessary means of personal hygiene, they do not have personal belongings, clothes and toys. During the visit, the monitors discovered humanitarian aid, which has been in the institution for more than a year, but the means of personal hygiene did not reach the children during the year. According to the inspection data, the food block stores products with an unknown expiration date.

“One child, who is allergic to certain foods, often remains hungry in the evening because he is not offered an alternative,” the message states.

In addition to the fact of improper conditions for the stay and comprehensive development of the child, alcohol was found in the classroom for cooking classes in open access for children.

“The management of the institution emphasizes that the children do not use the study room, but it is used exclusively by the staff as their own dining room. The children informed the monitoring group that similar “celebrations” were organized by the school staff more than once,” the report states.

The name of the institution is not disclosed in the message of the Human Rights Commissioner of the Verkhovna Rada. However, lawyer Inna Miroshnichenko, who posted photos taken during the inspection on social networks, indicated that it was the Novosilsk special school of the Ternopil Regional Council.

Based on these facts, juvenile prosecutors initiated criminal proceedings under Art. 137, Art. 151, Art. 153, Art. 364 of the Criminal Code of Ukraine (improper performance of one’s professional duties regarding the protection of life and health of minors, illegal placement of a healthy person in a psychiatric institution, sexual violence, abuse of official position). The investigation was entrusted to the police.
