Accused of riots in the United States on January 6, 2021, when protesters stormed government buildings, are en masse filing requests to postpone the cases, citing the victory of Donald Trump in the presidential election. About this UNN writes with reference to CBS News.

Details

Waves of those accused of rioting at the US Capitol are citing the election of Donald Trump as justification for their requests to delay their criminal prosecutions. They recall his public promise to pardon some people convicted of crimes on January 6, 2021.

CBS News has seen court documents in which defense attorneys are asking federal judges to delay some of the Capitol storming cases until after Trump takes office.

A lawyer for one of the defendants noted that during Trump’s first term as president, Trump pardoned, commuted or canceled the sentences of 237 people, although many of them were controversial. Some of the defendants are citing Trump’s campaign statements in their new court filings.

The number of requests for adjournment is expected to increase significantly. Attorney Joseph McBride, who represented several of the criminal defendants on Jan. 6, told CBS News that requests to delay the cases before Trump takes office will be made by all of the defendants.

It would be foolish not to. The question of pardon is coming up. And I don’t think any of that harassment will continue after (Trump takes office)

Let’s add

Due to these petitions, which will be required to be considered by the courts, the Ministry of Justice may not have time to complete the court processes before the change of power. It is noted that hundreds of cases are still pending in the courts.

The Department of Justice filed more than 1,500 criminal cases in connection with the prosecution of participants in the siege of the Capitol. According to federal data, approximately 950 defendants have pleaded guilty and another 200 have been found guilty in court. In August, the first defendant was sentenced: Michael Sparks, who broke into the Capitol on January 6, was sentenced to 53 months in prison. He was found guilty of six charges. Trump’s former adviser was also convicted.

Arrests continue, including new cases opened in the past few weeks.

We will remind

The storming of the US Congress building took place on the evening of January 6, 2021, during the Senate meeting, which was supposed to approve the results of the US presidential election – the victory of Joseph Biden. During the assault, clashes between protesters and the police took place in the premises.

A case is pending in the US Supreme Court that could affect hundreds of trials related to the 2021 attack on the residence of Congress, including the federal impeachment against Trump. At the same time, the Supreme Court ruled that Trump could have immunity for actions during his presidency related to the storming of the Capitol on January 6, 2021.
