The commercial court of the Kharkiv region ordered the joint-stock company “Ukrtelecom” to return the civil protection building (shelter) in the Kharkiv region to the State Property Fund of Ukraine.
About this testifies court decision from October 23.
It is about an anti-radiation shelter of 150 square meters in the city of Zmiyiv, Chuguyiv District, Kharkiv Region, on St. Administrative, 5. The storage room is located in the basement of a three-story building owned by Ukrtelecom.
The representative of the State Property Fund explained to the court that in 2011, according to a joint order of the FSMU and the Administration of State Special Communications, a territorial commission was created for the Kharkiv region, which established the presence of state property that was not included in the authorized capital of “Ukrtelecom”, but was on its balance sheet .
At the same time, this commission did not provide the Fund with information about shelters in Zmiiv street Administrative, 5. That is, the list of privatized property of “Ukretelecom” actually includes a civil defense facility – a civil defense building.
The court established that the disputed warehouse is an independent immovable property belonging to the state. And at the time of the emergence of disputed legal relations, there was a legal ban on the transfer of storage facilities from state to private ownership.
The court also came to the conclusion that the violated rights and legitimate interests of the state are subject to protection, which means the return of the state property fund of the shelter with an area of 150 square meters.
As a result, the Economic Court of the Kharkiv region
- invalidated the order dated November 25, 2003, by which the real estate that was on the balance sheet of UDPEZ “Ukrtelecom” under the Kharkiv Directorate was transferred to the ownership of OJSC “Ukrtelecom”. It is only about shelter
- obliged “Ukrtelecom” to return the storage facility to the State Property Fund and recognized that it now belongs to the FSMU.
The ultimate beneficial owner of JSC “Ukrtelecom” is Rinat Akhmetov.
