“Centrenergo” company won a court case against “Azonex” for the amount of UAH 70 million under the coal supply contract.

According to the case materials, Centerenergo claims that Azonex did not fulfill its obligations to supply the goods in full, and also did not return funds for the total amount of UAH 2.33 million, which is the difference between the actual cost of the delivered goods and advance payment. In this regard, the plaintiff filed a lawsuit for the recovery of UAH 22.33 million, 3% annual interest in the amount of UAH 808 thousand, as well as inflationary losses in the amount of UAH 2.18 million.
In addition, “Azonex” did not draw up and did not register tax invoices for payments in accordance with the contract in the Unified register of tax invoices, which led to the impossibility of accruing a tax credit in the amount of UAH 39.06 million. In this regard, Centernergo also filed a lawsuit for damages in the amount of UAH 39 million, 3% annual interest in the amount of UAH 3.8 million, and inflationary losses in the amount of UAH 1.5 million.
The court established that “Azonex” did not deliver the goods for the amount of advance payment of UAH 22.33 million.
“Taking into account the circumstances established by the court and comprehensively investigating the case materials, at the time of the case hearing, the court partially satisfied the claims of PJSC “Centrenergo” against LLC “Azonex”, the decision reads.
The founder of “Azonex” LLC is Andrii Martynovskyi. In 2020, the company imported coal from Poland. The company was also featured in the Bigus.info investigation “For the sake of Kolomoiskyi, Centerenergo switched to Russian coal.”
