The commercial court of the city of Kyiv collected from ATB-Torgstroy LLC in favor of the Kyiv City Council UAH 503,000 of unreasonably saved funds for the use of a plot of land.

As established by the court, in January 2024, “ATB-Torgstroy” applied to the Kyiv City Council with a request to lease a plot of land with an area of 0.085 hectares (cadastral number 8000000000:72:223:0009) on the street. Ushinskogo, 27 in the Solomyanskyi district of Kyiv.
The Department of Land Resources of the KMDA has prepared a draft decision on the lease of this plot. The explanatory note states that in 2015, “ATB-Torgstroy” registered a store of food and non-food goods with an unloading ramp with an area of 582 square meters on this land.
According to the prosecutor’s office, “ATB-Torgstroy”, as the owner of the supermarket on the street Ushinskoho, 27, until 2024 not only did not register the right to lease the land plot under the store, but also did not pay the rent, used it free of charge and without a sufficient legal basis.
That’s why the prosecutor’s office went to court to collect from “ATB-Torgstroy” 503 thousand UAH of unjustly saved funds for rent.
The court established that the plot with an area of 0.085 hectares on the street Ushinskogo, 27 in Kyiv was formed in 2021. And since at least 2022, the Kyiv City Council has known about the use of it by “ATB-Torgstroy” without paying rent. At the same time, the capital’s city council did not apply to the court for reimbursement.
In the Kyiv City Council, this was explained by the difficult economic situation and the introduction of martial law in Ukraine, as a result of which the city council was limited in funding and expenses for the payment of court fees, because the social, military and defense spheres are financed in the first place.
Since the Kyiv City Council did not go to court, the prosecutor’s office did it. The court agreed with her arguments and charged ATB-Torgstroy LLC with UAH 503,000 of unreasonably saved funds for the use of the land plot.
The court also emphasized that “ATB-Torgstroy’s” use of a plot of land without legal documents not only caused losses to the local budget, but also discriminated against other land users, who find themselves in a worse economic situation, along with subjects who evade the proper registration of relations in the land sector and the payment of rent” .
Beneficiaries of “ATB-Torgstroy” are Gennadiy Butkevich, Yevgeny Ermakov and Viktor Karachun. The head of the company is Tetyana Alexiuk.
