Ferrexpo announced the catastrophic consequences for the economy due to the actions of the Prosecutor General’s Office

The company reminds that for the first time 2,382 wagons were arrested in October at the request of the Prosecutor General’s Office.

Ferrexpo announced the catastrophic consequences for the economy due to the actions of the Prosecutor General's OfficeFor the third time, the Prosecutor General’s Office submitted a petition to the Pechersk Court to seize the wagons of the Ferrexpo mining company, which controls Poltava, Yeristiv and Bilaniv GZK.

The company declares the illegality of this request and the catastrophic consequences for the Ukrainian economy due to the blocking of wagons – due to the inability of Ferrexpo to supply products to Europe, European buyers may switch to using Russian products, which are still not under sanctions – Ukraine may lose not only foreign exchange earnings, and market positions.

The company reminds that for the first time 2,382 wagons were arrested in October at the request of the Prosecutor General’s Office. In April 2024, the Pechersk District Court canceled the ban on the use of wagons, finding it unfounded. During this time, Poltava GZK suffered losses of 103.3 million hryvnias.

Ferrexpo points out that the submission of the third request for the seizure of wagons from the OGP is illegal, since the Pechersk Court does not have jurisdiction to consider it – since the OGP and the DBR have already sent an indictment to another court in the case in which these wagons are physical evidence, since they iron ore processing waste was transported, which the investigation called “crushed stone”.

“Therefore, in accordance with Article 170 of the Criminal Procedure Code of Ukraine (CPC), the Pechersk District Court of the city of Kyiv no longer has jurisdiction to consider this petition. This is due to the fact that after the transfer of the indictment to the court, all petitions regarding the seizure of property must be considered by the court , which is engaged in the consideration of the case on the merits, which in this case should be the local court at the location of the enterprise,” Ferrexpo said in a statement.

The company notes that the hearing of the request for arrest is scheduled for September 26 by the investigating judge of the Pechersk District Court of Kyiv.

“The company once again calls on the prosecutors of the General Prosecutor’s Office to stop illegal, illegal actions that do not correspond to the law, state interests and are aimed at creating obstacles for the economic activity of the company, and to withdraw the submitted request for arrest,” Ferrexpo said.

It will be recalled that on September 24, the Prosecutor General’s Office reported that the prosecutors sent an indictment to the court against four officials of Poltava Mining and Processing Plant PrJSC and three officials of a private structure, who were accused of “seizing minerals of national importance” in the amount of 380 million hryvnias.
