The Economic Court of the Kharkiv region charged the expenses related to the transportation and storage of physical evidence (wheat and corn) in the amount of UAH 4.17 million from the state budget of Ukraine in favor of Dobrobud-Service LLC.

In April 2023, the investigative department of the Security Service of Ukraine in the Kharkiv region turned to “Dobrobud-Service” (Balaklia of the Kharkiv region) with a proposal to preserve physical evidence in criminal proceedings No. 22022220000003162 dated 10.15.2022. It was about agricultural products: wheat and corn. The company agreed.
Later, from the city of Kupyansk to Balaklia, where “Dobrobud-Service” has a complex for the reception, storage and shipment of agricultural products, 1.42 million kg of wheat with a net weight (taken into account when calculating the storage cost) of 1.39 million kg and 105 thousand kg of corn with a net weight of 87 thousand kg.
In June, the SBU informed “Dobrobud-Service” that wheat and corn were seized with the transfer of these agricultural products to the National Agency of Ukraine for the Identification, Search and Management of Assets Obtained from Corruption and Other Crimes (ARMA). As the defense of “Dobrobud-Service” noted in court, the company did not receive any appeals regarding the seized property from ARMA.
As of March 31, 2024, fromthe total amount of costs for the storage of agricultural products, including the cost of transportation (the largest share of costs), unloading and loading works, cleaning and disinfection, amounted to UAH 4.17 million.
During the storage period, “Dobrobud-Service” repeatedly sent invoices and claims to the SBU regional administration regarding the reimbursement of the cost of services for storing agricultural products, which were not considered. As a result, the company decided to receive UAH 4.17 million through the court.
In the court, the Security Service of Ukraine reported that it considers the demands to recover costs for the transportation of agricultural products from the city of Kupyansk to Balaklia to be groundless.
At the same time, the court rejected all the arguments of the SBU administration. In particular, regarding the storage of grain as agreed by the parties until the decision on the seizure, since, as the court noted, after the seizure of wheat and corn, no instructions and management decisions were received from the Security Service of Ukraine regarding the storage of grain.
As for ARMA, the agency noted that it is preparing the asset for transfer and searching for a manager/realization of the property, and during the performance of functions related to property management, there were no contractual relations between LLC “Dobrobud-Service” and ARMA.
The court established that, in any case, the costs of storing material evidence in criminal proceedings are covered by the state budget. Therefore, I decided to withdraw UAH 4.17 million from the state budget in favor of “Dobrobud-Service”. and UAH 50,000. court fee
The owners of “Company “Dobrobud-Service” LLC are Oleg Polyarush, Vasyl Kolisnyk and the head of the company Serhii Neshchenko.
Polyarush, together with Serhiy Neshchenko, are co-founders of the Izmail-based Agro-Danuy LLC and the Kyiv-based Crew Trading LLC with Serhiy Teplytskyi and Serhiy Burnay.
Polyarush also single-handedly owns Skyron LLC, Royan Company LLC, and Everest Construction LLC from Kharkiv. The latter featured in the journalistic material about inflated prices during the emergency restoration of two residential buildings in Balaklia.
