Asked by the Financial Times about the warrant for Netanyahu’s arrest, Starmer’s spokesman said the government “will always comply with its legal obligations under domestic law as well as international law.”
However, Starmer’s spokesman stressed that the government does not comment on hypothetical situations.
The statement came after Germany made it clear it would not comply with an arrest warrant issued by the ICC, the first of its kind for a Western leader.
According to the publication, Germany, in view of its historical responsibility to Israel, expressed doubts about the possibility of executing the warrant. “It is difficult for us to imagine that we will make arrests on this basis,” said the spokesman of the German government, Steffen Gebeshreit, emphasizing the “unique relationship” with Israel.
The warrant obliges the ICC’s 124 member states, which include most European, Latin American, African and Asian states, to detain Israeli Prime Minister Benjamin Netanyahu and his former defense minister, Yoav Galant, if they appear on their territories.
However, the execution of warrants depends on member states, since the ICC itself has no mechanisms for their enforcement.
Netanyahu’s office called the warrants anti-Semitic, and the court itself a “biased and discriminatory political body.”
Under British legislation from 2001, the Foreign Secretary is required to hand over ICC warrants to law enforcement agencies, who must act if there are grounds to believe the warrant is valid. However, representatives of the British government, including Home Secretary Yvette Cooper, avoid unequivocal statements, citing the need to follow procedures.
Other European countries, such as Spain, Italy, the Netherlands and Ireland, have confirmed their readiness to fulfill their obligations to the International Criminal Court, the publication indicates.
