The Transcarpathian District Administrative Court found the order of the Uzhhorod Regional Territorial Recruitment Center to call up a lawyer for military service illegal and annulled it.
The National Association of Lawyers of Ukraine reported on the relevant decision in case No. 260/6813/25 adopted on November 28.
It is noted that the lawyer Ljubomir Tsebryk, who worked with the cases of former police officers, was detained on July 21 of this year simply in the district police department – while reviewing the materials of official investigations at the lawyer’s request. Employees of the TCC blocked his exit, demanded his military registration documents and, despite the current postponement, took him to the territorial center.
According to the lawyer, he was detained at the TCC for several hours without explanation and without specifying the reasons for the detention. Appeals to the MOU government hotline and calls to the police did not yield results. In the evening, the man was offered to undergo a military medical examination, and later he found out that on the same day the TCC canceled his deferment by protocol decision.
When the lawyer refused to go to the military unit without documents, his phone was taken from him and force was used. In the hospital, medics recorded a rib fracture, chest injury and other injuries. His phone was returned to him only the next day – already after his official enlistment in the military unit. After the incident, the lawyer turned to NAAU.
The National Association of Lawyers of Ukraine submitted a statement to the Prosecutor General’s Office about the possible commission of crimes by employees of the police and TCC. These are obstruction of legal practice, illegal deprivation of liberty, illegal detention, interference with electronic systems, and causing bodily harm of moderate severity.
At the same time, the lawyer contested the actions of the TCC and the military unit in an administrative procedure. The court opened proceedings and involved NAAU as a third party in the case.
After studying the materials, the court came to the conclusion that the cancellation of the postponement, the re-referral to the VLK and the draft were carried out in violation of the law. The order of the TCC on the conscription, referral and enlistment of a lawyer to the military unit has been cancelled. The court qualified the failure to grant him a postponement as illegal inaction.
