People’s Deputy Andriy Odarchenko tries to protest in court a sentence of the Supreme Anti -Corruption Court of Ukraine (VAKS), who found him guilty on November 14 in an attempt to bribe the Bitcoins at that time the head of the State Agency for the Restoration of Mustafa Nayem. Odarchenko is currently abroad, and the lawyers have filed a request for cancellation.
The appeal, which appeared on the network, states that the VACCU sentence should be canceled because the trial was incomplete and the sentence did not meet the conclusions of the court of first instance stated in the court decision, the actual circumstances of criminal proceedings. In general, according to the lawyers, the Law of Ukraine on Criminal Liability was misapplicated.
During the trial, Odarchenko testified that Nayem, having taken advantage of the situation and being on confidential cooperation with NABU, provoked the People’s Deputy for proposal and providing undue benefit. According to Odarchenko, this would not happen without active (provocative) actions of Nayem.
“The defense party substantiated its position with reference to specific evidence, which was fully reflected in the judicial debate, which was attached to the case file. Of all the testimony of O., the court was taken into account only the recognition that N. was offered an undue benefit and subsequently provided (provided). All other circumstances, which are essential for the case and are confirmed by the evidence, including the prosecution provided, the court was left unattended because they were not consistent with the position of the prosecution, ”the appeal state said.
The situation with the institute
As stated in the verdict, as a result of the armed aggression of the Russian Federation against Ukraine, the building of the State Biotechnology University underwent significant destruction, so there was a need for funds for their restoration. The witness was questioned at the court session that Odarchenko appealed to the allocation of funds from the Fund for Elimination of the Consequences of Armed Aggression for the State Biotechnological University.

The history of the question
Last November, the National Anti -Corruption Bureau (NABU) sent materials to Interpol for the wanted People’s Deputy from the Servant of the People, Andriy Odarchenko, who was found to be guilty of trying to give a bribe to the head of the State Agency for the restoration of Mustafi.
On November 14, the Supreme Anti -Corruption Court found People’s Deputy Andriy Odarchenko guilty of trying to bribe the expert of the State Agency for the restoration of Mustafa Nayem. Odarchenko tried to bribe in bitcoins, for which the court appointed him eight years in prison. This was the first time that anti -corruption bodies recorded a bribe in cryptocurrency.
According to the prosecution, a former member of the Committee on Anticorpolitics Andriy Odarchenko in August 2023 proposed Mustafi to the Bitcoin bribes at the equivalent of $ 50,000 to obtain funds from the Fund from the Fund for Elimination of the Consequences of Aggression on Repair of University buildings. The defense party claimed that there would be no crime without provocation. At interrogation in court Odarchenko acknowledged that he really offered a bribe, but Nayem allegedly forced him to do it because he convinced that otherwise the money would not be allocated. In her turn, the prosecutor noted that Odarchenko only reported the provocation after he left Ukraine. In her opinion, the recorded conversations between him and Namom do not contain signs of provocation, and Odarchenko offered a bribe several times.
The prosecution has asked for 10 years of imprisonment for Odarchenko with deprivation of the right to occupy certain positions and confiscation of all property.
On June 3 last year, Mustafa Nayem was released from the post of Head of the State Agency for Restoration.
